CROSS-EXAMINATION OF MEDICAL DOCTOR BY COUNSEL TO #ENDSARS PROTESTERS, MR. ADESINA OGUNLANA
O(OGUNLANA): Is it true that your Medical Centre treated some people on the 20th, 21st and 22nd October, 2021?
D(DOCTOR): Some were treated for gunshot injuries . Some were bruises . Some came in as contuitions and convulsions.
O: Did you treat Nicholas Okpe, Olalekan Faleye and Patrick Ukala?
D: The only record here is Patrick Ukpolo, treated for gunshot injury , right forearm. He was referred from Reddigton Hospital.
O: If you see the Patrick , can you be able to identify him ?
D: Yes.
O: (Calls out Patrick Ukala): Is he the one?
D: Yes, he is the one. I was one of the people who treated him.
O: That will be all for this witness.
CROSS-EXAMINATION BY COUNSEL TO NIGERIA POLICE FORCE, J. I. EBOSEREME ESQ.
E(EBOSEREME): The patients that were brought to your Hospital, did they tell you what happened?
D(DOCTOR): Yes
E: The documents you tendered are based on what you were told?
D: I was only interested in Medical information. I was not interested in any other information.
E: Did any of the patients say they were shot by the Police? Did you ask?
D: No, that was not part of our medical history.
E: That will be all for this Witness.
CROSS-EXAMINATION BY COUNSEL TO THE PANEL, MR. JONATHAN OGUNSANYA
O(OGUNSANYA): Do you confirm that the Medical Records before you are part of documents submitted to the Panel?
D: Yes.
O: That will be all for this witness.
CROSS-EXAMINATION BY COUNSEL TO LEKKI CONCESSION COMPANY, MR. ROTIMI SERIKI
S(SERIKI): When did you become a Medical Doctor?
D: I became a Medical Doctor in 2004. I am a Fellow of West African College of Physicians. I am a specialist in Plastic Surgery. Every Surgeon is treated all wounds. I have treated gunshot wounds before 20th day of October, 2020. I can't recall how many gunshot wounds I have treated.(....)I am familiar with Lekki Toll Gate. I have never counted the traffic junctions but I am aware that there are 7 traffic junctions controlled by traffic lights.
S: Is it correct to say that gunshot wounds lead to blood loss?
D: It can also be a glazing wound. But gunshot penetration leads to blood loss. There are 15 patients with gunshot victims . None of them have glazing gunshot wounds. There is 1 patient with laceration among the 15 patients with gunshot wounds . They all have gunshot penetration.
S: Do you agree that the patients with gunshot penetration would need to be taken to the nearest hospital?
D: Yes
S: As a Medical Practitioner, you are aware that from Lekki Toll Gate, there are several hospitals within that route?
D: I am aware
S: How many of the patients were referred from Reddigton Hospital, Lekki?
D: 6 patients were referred from Reddigton Hospital, Lekki.
S: Which location of Reddigton Hospital referred them?
D: I don't know. I know Reddigton operates from different locations in Lagos. They were brought in by ambulances. I don't take note of which location of Reddigton Hospital they were brought from. No patient was brought in unconscious. I did not extract bullets from any of them.
S: That will be all for this witness.
CROSS-EXAMINATION BY COUNSEL TO LAGOS STATE GOVERNMENT, A.J. OWONIKOKO SAN
O(OWONIKOKO): You confirm that your hospital handled 6 referrals from Reddigton?
D: Yes
O: Are those Referrals contained in Exhibit A?
D: Yes
O: Is there anyone of the 6 that have instrument of referral?
D: I can't confirm any letterheads from Reddigton.
O: Your facility is a Trauma Centre?
D: Yes sir
O: Trauma injuries are not restricted to gunshots?
D: Yes sir
O: Your determination of trauma is not just based in Physical examination, there are other means of examination?
D: CT Scan, MRI
O: There is this requirement of Primary Survey...the ABCDE...Airwave Flow, Breathing, Circulation, Disability and Exposure, do you confirm?
D: Yes
O: These 6 patients for Reddigton Hospital, where was this Primary Survey conducted?
D: Both facilities are supposed to do so.
O: Can you confirm that they have primary Survey in their facilities ?
D: Yes, they do.
O: Do you confirm Secondary Survey follow Primary Survey?
D: Yes.
O: Can you explain Secondary Survey?
D: The most important thing is to ensure that the patient is breathing. We want to check secondary injuries.
O: There is Nicholas Okpe, Patrick Ukala ...
D: Patrick Ukala is correctly spelt in the Case Note...the Summary Print has an error.
O: There is Samuel Ashaola, Solomon Ago, Olalekan Faleye (from Vedic), Asue Roland...from Reddigton...
D: We don't have CT Scan, MRI as at that time...one that I followed fully...Samuel Ashaola has X-ray of left shoulder, Asue Roland has X-ray of the Skull, Ogbonna has X-ray of the right leg and Nicholas Okpe has X-ray of the Chest. Aina Harrison has CT Scan. They are 7.
O: All these patients had their X-ray conducted outside(sic) your facility?
D: Yes
O: I will like to take you to Solomon Samuel...your case note confirms that he has a gunshot injury to the shoulder...
D: Yes. I confirm that there were no bullets extracted from the patients.
O: Can we have Solomon Agie's X-ray and Report. The purpose of the X-ray is to ascertain the nature of the objects ...
D: The first part ...yes... and the other part is cloudy. The X-ray says there is no bone fracture . There is no evidence of metallic object or sharpnel.Thee are different gunshot injuries depending on the gun and how close the gun is. Gun velocity is the speed of the bullet and there will be more damage done to the internal structures that it runs through. I don't know whether high velocity will depend on military guns. I cannot say whether Solomon Agi was shot with either high or low velocity weapons. We could not find an exit wound on Solomon Agi. There are other persons treated for gunshot injury. I wouldn't know whether they suffered high velocity or low velocity gunshot injuries. A forensic pathologist is the one that can determine that. A forensic ballistician can also help. I can't confirm that an highly experienced military officer can help..."
O: Let's look at Samuel Ashaola...the nature of injuries was laceration to the thigh. Is that injuries consistent with gunshot wounds?
D: He was brought in on 21st October, 2021 by 12: 15am. He was transferred from Reddigton Hospital. All the patients came in a conscious state. We do not have access to Case Notes. We do not have previous history of patients. The most important thing in an emergency is to save the life of the patient. You can have spillover , it is still an emergency...
